The vast majority of Seneca’s litigation assignments have resulted in settlements that were deemed attractive to our clients. These settlements have included results where:

• Seneca determined the value of collateral to be far below the lien claim resulting in a settlement of cents on the dollar, leaving more value to be distributed to unsecured creditors;
• Seneca’s analysis of the plaintiff’s expert report revealed that the expert had altered significant third party materials to support his conclusions;
• In a case involving a fee dispute, Seneca was able to demonstrate that the advice rendered by the investment banking firm would have bankrupted the client had it been implemented;
• Seneca was able to demonstrate that the plaintiff’s motion was in direct contradiction of its own public statements concerning a similar occurrence in one of its operating subsidiaries; and
• Seneca was able to demonstrate that a plan proposed by a debtor was not feasible because key underlying assumptions were not attainable and third parties concluded the same.
